Business Use of a Public Footpath

Approval is required from Council for business use of public footpath areas.

Outdoor Dining Approvals

An outdoor dining approval permits a business owner to occupy an approved area for the purpose of outdoor food/beverage service. This does not include fixed structures.

Fixed structures include umbrellas, awnings, pavilions, landscaping and planter boxes. An application for a fixed structure attracts an additional one off application fee. A fixed structure application will only be assessed where there is an existing outdoor dining or street vending approval on the subject property and only with the same approval.

Street Vending on a Public Footpath

This approval allows a business owner to erect an approved display (stand/rack) in the footpath area directly outside their shop as well as sell the approved goods within the approved area. Examples include florists, green grocers and clothing shops. Additional information and requirements can be found in the Business Use of a Public Footpath Factsheet.

Unsuitable items placed within the footpath area would include but are not limited to whitegoods, boxes, crates, electrical and/or other large goods. 

This approval is not to be confused with an approval for the Conduct of Street Stalls and Raffles on Public Property (under Policy Conduct of Street Stalls and Raffles on Public Property T5.02), which permits accredited organisations to operate street stalls and sell raffle tickets on public property up to five times per year.
